Bombora, Inc. and its global subsidiaries (“Bombora”, “we”, “us”, or “our”) offers a hosted platform and related analytics products (collectively the “Services”) to businesses (“Subscribers”) to help Subscribers obtain information, connect and target organizations they want to reach (we refer to the individuals in those organizations as “End Users”)

1. Who we are

This Privacy Notice explains how we process personal information: (a) in connection with developing, improving and providing our Services; and (b) when you visit one of our corporate websites (such as https://bombora.com, www.netfactor.com, https://insights.bombora.com, https://surge.Bombora.com) (“Websites“) and in the usual course of our business practices, such as in connection with our events, sales and marketing activities.

2. Privacy for our services

This section describes how we collect and use personal information we receive or collect from End Users through our Service and obtain from third parties (we refer to this collectively as “Service Information”). This includes the types of information we receive from other sources and the purposes of those collections.

2.1. Personal Information we collect automatically

Tracking Across Digital Properties – Bombora and its Partners monitor End User interactions across various platforms, including web registration forms, widgets, websites, and webpages, regardless of the device or technology used to access them (collectively, “Digital Properties”). To facilitate this, we assign a random unique identifier (“UID”) to your device upon your first interaction with a Digital Property, which allows us to associate collected information with your specific device.

We collect Technical Identifiers and engagement metrics, categorized as “Event Data.” This includes:

  •         Technical Identifiers: unique ids (including cookie ids), ip addresses, email addresses, hashed emails, page and referrer URLs, browser type, operating system, and language.
  •         Engagement Data: Metrics such as dwell time, scroll velocity, scroll depth, and time between scrolls.

We utilize Engagement Data specifically to validate active content consumption and distinguish genuine user interest from “bouncing” behavior. We do not use Event Data to identify individuals by name or physical mailing address, nor do we attempt to reverse-engineer the Event Data for such purposes.

Analysis and Company Aggregation – Bombora analyzes content consumed across Digital Properties and categorizes it using the Bombora topic taxonomy. Where Event Data allows us to identify the company an End User represents (via company name or URL), we aggregate the associated topics and events into a singular company profile.

The information we automatically collect includes:

  •         Device and Usage Data: Device type, model, manufacturer, operating system (e.g., iOS, Android), carrier, time zone, network type, and device-specific advertising identifiers such as IDFA or AAID/GAID.
  •         Online Behavioral Data: Activity logs on Digital Properties, including time spent on pages, scroll/click actions, session timestamps, referring URLs, and geolocation data (ranging from city/zip code to geographic coordinates, if enabled on your device).
  •         Advertising Data: The type of advertisements served, their location, your interactions with them (clicks), and frequency of exposure.

Data Enrichment and Inferences – The Service Information we collect may be combined with inferred business profile information to enhance our insights. This includes data points such as domain, functional area, seniority, professional group, industry, company revenue, net worth, and household income status.

Communication Application Data – When interacting with Bombora via communication platforms (e.g., Zoom or Gong), we may automatically collect log information (date/time stamps), IP addresses, and business email addresses.

2.2. Information we receive from other sources

We also combine, merge, and/or enhance the Service Information we collect about you with information obtained from third parties such as other web-based networks, exchanges (“Partners”). or our Subscribers (for example, they may upload certain “offline” data into the Services). These third parties may set and access cookies on your computer or other device and may also use pixel tags, web logs, web beacons, or other similar technologies.

2.3. How we use your personal information (our purposes)

We use the Services Information as follows:

  •       To provide the Services to our Subscribers including by building inference-based data segments (“Services delivery”). Generally, we use the Service Information to help Subscribers better understand their current and prospective customers and market trends. The data segments also may be associated with UIDs, cookies, hashed emails and/or mobile device advertising IDs.
  •       “Interest-based advertising and cross device tracking”. We sometimes use or work with Subscribers and Partners that use UIDs or other information derived from information such as hashed emails and/or mobile device advertising IDs. This information in turn may be associated with cookies and may be used to target ads to you that are based on “offline” interest-based segments – such as your interests, transactions or general demographic information. This is often known as “interest-based advertising.” Visit the  DAA’s website for more information.
  •       We (or our Partners and Subscribers we work with) may use the Service Information to try to locate the same unique users across multiple browsers or devices, or work with providers that do this in order to better target ad campaigns to common sets of End Users.
  •       “User matching”: We (or our Partners) may use the Services Information, in particular various UIDs, to sync cookies and other identifiers with other Partners and Subscribers (i.e. for “user matching“). We may also receive a list of UIDs our Partners or Subscribers have assigned to an End User. When we identify matches, we then let our Subscribers and Partners know in order to help them do any of the above, including enhancing their own data and data segments to do interest-based advertising or provide insights to other customers.

To comply with applicable law: including laws outside your country of residence (“Compliance and Protection”). More specifically, this includes:

  • to comply with legal processes
  • to respond to requests from public and government authorities including authorities outside your country of residence
  • to enforce our terms and conditions
  • to protect our operations or those of any of our affiliates
  • to protect yours, our affiliates and/or our rights, privacy, safety or property
  • to allow us to pursue available remedies or limit the damages that we may sustain.

3. Privacy for our websites

This section describes how we collect and use personal information when you visit our Websites and/or provide information to Bombora over the usual course of our business practices, such as in connection with our events, sales and marketing activities.

3.1. Personal Information you provide to us

  1. Business contact data you provide to us, for example when you request a demo, express an interest in obtaining additional information about Bombora and/or our Services, join an event or subscribe to marketing emails. The personal information we collect includes, but is not limited to:
  • first and last name
  • business email address
  • phone number
  • professional information (e.g. your job title, department or job role) as well as the nature of your request or communication.

2. Applicant data you provide to use when applying for a job on our career page  when you submit an application. The personal information we collect includes, but is not limited to:

  • first and last name

  • professional information (e.g. your job title, department or job role) as well as the nature of your request or communication

3.2. How we use your information

We will use your personal information for the following purposes:

  •       To manage and improve our Websites, including data analysis, identifying usage trends, determining the effectiveness of our marketing and to enhance, customize and improve our Websites and Services.
  •       To respond to communications or provide you with the information you request.
  •       If you have an account with Bombora, to manage your user account and to send you administrative or account related communications.
  •       If you have applied for a role with Bombora: to evaluate your application and make hiring decisions, communicate with you and inform you of current and future career opportunities (unless you tell us that you do not want us to keep your details for such purposes), manage and improve our recruiting and hiring processes, or to conduct reference and background checks where required or permitted by applicable local law.
  •       To post testimonials with your prior consent.
  •       To manage events and communicate with you about our events or our partner events.
  •       To provide you with marketing and promotional communications (where this is in accordance with your marketing preferences) or other information about our Services).
  •       To comply with and enforce applicable legal requirements, agreements and policies.
  •       To prevent, detect, respond and protect against potential or actual claims, liabilities, prohibited behavior and criminal activity.
  •       For internal business purposes including but not limited to data modeling and training our algorithms to increase the accuracy of our models.
  •       For operational and security purposes related to our business.

3.3. Cookies and similar tracking technologies

We use cookies and similar tracking technology to collect and use personal information about you, including to serve interest-based advertising. For more information about cookies and tracking technologies we use, why, and how you can control cookies, please see our Cookie Statement.

3.4. How we share your personal information

Your personal information collected through our Services and Websites are disclosed as follows:

Subscribers and Partners. If you are an End User, we share Service Information with Subscribers and Partners for purposes relevant to our business relationship with them and for purposes described in this Privacy Notice.

Vendors, consultants and service providers. We share your personal information (including Service Information) with a variety of third-party service providers. Examples of this include but are not limited to: (i) assisting with technical, operational, or hosting support, software and security services or to enable the Services that we offer; and (ii) assisting us with our recruitment process (for example the information that we collect for employment applications is shared with Greenhouse Software, Inc. The software that we use for recruiting management. To assist with the recruitment process we may use an artificial intelligence solution.

  •       Website advertising partners. We may partner with third party advertising networks and exchanges to display advertising on our Websites, or to manage and serve our advertising on other sites and may share your personal information with them for this purpose.
  •       Vital interests and legal rights. We may disclose information about you if we believe it necessary to protect the vital interests or legal rights of Bombora, you or any other person.
  •       Corporate affiliates and transactions. We reserve the right provide your personal information to our affiliates (meaning any subsidiary, parent company or company under common control with Bombora) for our administrative purposes, including activities such as IT management, for them to provide Services to you or support and supplement the Services we provide.
  •       Potential acquirers of our business. If Bombora is involved in a merger, acquisition or sale of all or a portion of its assets (including negotiations thereof) or due diligence related to such a potential transaction, your personal information may be shared or transferred as part of that process with the relevant potential buyer, its agents and advisors, as permitted by law. Please note that any potential buyer will be informed that they should use your information only for the purposes disclosed in this Privacy Notice.
  •       Compliance with laws. We may disclose your information to any competent law enforcement body, regulator, government agency court or other third party where we believe disclosure is necessary:
    i) as a matter of applicable law or regulation
    ii) to exercise, establish or defend our legal rights
    iii) to protect your vital interests’ rights or safety or those of any other person.

4. Your privacy rights and choices

As permitted under applicable law, you may need to provide us with some additional information to enable us to identify the personal information we hold about you and ensure that we accurately fulfill your request. Making a verifiable consumer request does not require you to create an account with us.

The information you supply in this form will only be used to: (i) identify the platform and/or business data you are requesting; and (ii) responding to your request.

4.1. Data subject requests and your data protection rights

To submit a request please complete the data subject request form or email dsars@bombora.com. Once you submit a request Bombora will process and respond to your request in the timeframe permitted under applicable law. You can also email privacy@bombora.com with any questions or queries you have regarding your data.

If applicable, the response we provide may also explain the reasons why we cannot comply with a request. Due to the nature of our company-level aggregation, we may not always be able to provide individual notice of law enforcement requests if the data cannot be directly linked to an identifiable individual without disproportionate effort.

You can opt-out of receiving promotional emails from us by clicking the “unsubscribe” link in the email or by completing the above form. If you choose to no longer receive marketing information, we may still communicate with you regarding your security updates, product functionality, responses to service requests, or other transactional, non-marketing, or administrative related purposes.

In addition to the other rights discussed in this policy, consumers, which are consumers as defined by applicable US state privacy law, as they become effective (“Applicable States”), have the right to submit a request:

  •       to know the personal information we may have collected, used or shared.
  •       to access to the personal information we may have collected, used or shared.
  •       to not be discriminated against for exercising any of your rights granted under the applicable state privacy laws.
  •       to modify, update, transfer the data that we may have collected used, or shared.
  •       to delete or correct your personal information that we may have collected, used or shared.
  •       to opt-out of the “sale” and “sharing”, including targeted advertising.

4.2.     Your choices

You can set or amend your web browser controls to accept or refuse cookies. If you choose to reject cookies, you can still use our website though your access to some functionality and areas of our website can be restricted. As how you can refuse cookies through your web browser controls vary from browser-to-browser, you should visit your browser’s help menu for more information.

When you opt-out, we will place a Bombora cookie on or otherwise identify your browser in a way that informs our systems not to record information related to your business research activities. However, please note that if you browse the web from multiple devices or browsers, you will need to opt-out from each device or browser to ensure that we prevent personalization tracking on all of them. For the same reason, if you use a new device, change browsers, delete the Bombora opt-out cookie or clear all cookies, you will need to perform this opt-out task again. 5. Other important information

5.1. Data security

Bombora takes precautions designed to protect data and information under its control from misuse, loss or alteration. Bombora has put in place appropriate technical and organizational measures designed to protect the information it collects through its Services and Websites. Bombora’s security measures include security measures regarding who may and may not access our information. Of course, no system or network can ensure or guarantee complete security, and Bombora disclaims any liability resulting from use of the Service or from third party hacking events or intrusions.

5.2. Children

Our Websites and Services are not intended for children under 18 years old. If you are aware of personal information we have collected from a child under 18, we ask that you contact us via one of the methods listed in the ‘contact us’ section.

5.3. Other websites

The Services or Websites may contain links to or integrations with other sites that Bombora does not own or operate. This includes links from Subscribers and Partners that may use the Bombora logo in a co-branding agreement, or websites and web services that we work with to provide the Services. For example, we might sponsor an event or provide services in conjunction with other businesses.

Bombora does not control and is not responsible for these parties’ sites, services, content, products, services, privacy policies or practices. These links and integrations are not an endorsement of, or representation that we are affiliated with, any third party.

Likewise, if you permit Service Information to be collected and used through a website using the Services, you are choosing to disclose information to both Bombora and the third party with whose brand the website is associated. This Privacy Notice only governs Bombora’s use of your Service Information not the use of any information by any other party.

5.4. International data transfers

We are headquartered in the United States, our servers and facilities that maintain our Websites, Services and the information we collect are operated in the United States. With that said, we are an international business that operates globally, and our use of your personal information necessarily involves the transmission of on an international basis.

In addition, we use service providers that operate in the United States and other countries other than the country in which you are resident. These countries may have data protection laws that differ from those of your country (and, in some cases may not be as protective as those in your state, province, or country).

Individuals located in the European Economic Area and the United Kingdom should read the information provided below about transfer of personal information outside of those locations.

5.5. Data retention and deletion

We retain your personal information for as long as necessary to fulfill the purposes for which we collected it, including for the purposes of satisfying any legal, accounting, or reporting requirements, to establish or defend legal claims, or for the compliance and protection purposes described in the privacy notice.

We may reserve the right to modify this Privacy Notice at any time to reflect changes in our practices or in the applicable law. When such changes are material in nature, we will notify you either by prominently posting a notice of such changes prior to implementing them and updating the date of this Privacy Notice or by directly sending you a notification. Any modifications to this Privacy Notice will be effective upon posting of the modified version (or as otherwise indicated at the time of posting).

EEA/ UK Supplemental Privacy Notice

The information provided in this supplemental notice applies only to individuals located in the European Economic Area (“EEA”), the United Kingdom (“UK”) and Switzerland (collectively, “Europe”). The personal information that we collect from you is identified and described in greater detail in this Privacy Notice.

Legal bases for processing. European data protection law requires that we have a “legal basis” for each purpose for which we process your personal data. Depending on the purpose for collecting your personal information, we may rely on one of the following legal bases:

  •       The processing is necessary to perform a contract that we are about to enter into, or have entered into, with you (“Contractual Necessity”).
  •       The processing is necessary to pursue our legitimate interests or those of a third party and we are confident that your privacy rights will be appropriately protected (“Legitimate Interests”).

Use for new purposes. In addition to the data protection rights grated in this Privacy Notice, if you are a Consumer, the California Consumer Privacy Act of 2018 as amended by “CPRA”(California Civil Code Section 1798.100 et seq) (“CCPA”) provides Consumers with the right to opt-out of the “sale” and “sharing”, including targeted advertising of their personal information, view, delete, transfer, modify the data Bombora may have collected from you, and to know the following:

  •       Professional or employment-related information: such as your job application, resume or CV, cover letter, references, education history, employment history, whether you are subject to prior employer obligations, and information that referrers provide about you, references, language proficiencies, education details, information you make publicly available through job search or career networking sites, voluntarily providing U.S. Equal Opportunity Employment Information, voluntarily provide your disability status, if you are legally authorized to work in the U.S, salary requirements and your LinkedIn profile URL.

You have the right to request certain information about our disclosure of personal information to third parties for their own direct marketing purposes during the preceding calendar year. This request is free. You also have the right not to be discriminated against for exercising any of the rights listed.

California residents may also designate an agent to make requests to exercise your rights under CCPA. As noted above Bombora will take steps both to verify the identity of the person seeking to exercise their rights, and to verify that your agent has been authorized to make a request on your behalf through providing us with a signed Power of Attorney. You may only make a verifiable consumer request for access or data portability twice within a calendar year.

 

If you are 16 years of age or older and a California Resident, you have the right to direct us to not sell your personal information at any time (the “right to opt-out”). We do not collect, store or sell the personal information of consumers that are under 18 years of age.
